The 2015 Waters of the United
States (WOTUS) rule has been deemed unlawful by a federal court.
The Southern District Court in Georgia found the EPA overstepped the Clean Water Act and the Administrative Procedures Act.
The court has kept the
preliminary injunction in place preventing the WOTUS rule from becoming
effective in the 11 states involved in the lawsuit as the EPA is finalizing its
own repeal and replacement of the rule.
