Agricultural contracts focus of June workshop

The Agricultural Contracting Program sponsored by the Indiana Agricultural Law Foundation will be presented virtually on Thursday, June 26, from 9 a.m. – noon (EST).

Contracts impact many aspects of agricultural production. The Agricultural Contracting Program will help farmers, landowners and ag stakeholders broaden their understanding of contracts and how they might impact their operations.

Speakers will focus on the differences between farmland leases and production contracts and the importance of having legally binding agreements:

  • Agricultural Contracting – The Basics – Todd Janzen, Janzen Schroeder Ag Law. Historically, some Indiana farmers have avoided written contracts believing they convey a lack of trust between the parties, while others see value in clearly documenting the duties and responsibilities of the parties to an agreement. Janzen will provide useful information regarding the basics of contracting, common terms and conditions and other considerations for farmers and landowners.
  • Agricultural Contracts – Harrison M. Pittman, the National Agricultural Law Center. This presentation will build on “Agricultural Contracting – The Basics,” and in it, Pittman will discuss different types of agricultural contracts, leases, and related issues and how they impact agriculture. He will also highlight federal contract termination and other discontinued federal obligations.
  • Renewable Energy Contracts – Brianna Schroeder, Janzen Schroeder Ag Law. Landowners looking to diversify their income or to create financial security for future generations may be drawn to solar energy, wind turbines or carbon sequestration projects. All these projects start with a contract between the property owner and the renewable energy company. Given the lengthy term and complexity of these contracts, landowners must fully understand the agreements put before them, and families should be ready to discuss their primary concerns and position their land for success now and into the future. Schroeder will highlight common terms associated with renewable energy projects.
